On November 25, 2025, the Missouri Supreme Court denied an effort to review the decision in a long-running dispute involving video service provider (VSP) fees in Missouri. In City of Creve Coeur, Missouri, and others similarly situated, v. DIRECTV and DISH Network, the Plaintiffs alleged that Defendants were liable for VSP fees on the grounds that Defendants’ video programming is provided to consumers through wireline facilities located in public rights-of-way.

Econic Partners Founding Partner Jonathan Orszag was retained as an expert on behalf of DISH Network to assess Plaintiffs’ claims. Mr. Orszag also responded to the Plaintiffs’ expert’s approach to determining damages, finding that his approach was flawed and did not isolate the part of DISH’s revenues that would be subject to VSP fees in Creve Coeur and/or Missouri.
